Talivo ("we", "our", or "the app") is a language learning application that uses your own photos and phrases to create flashcards and supports spaced repetition. This Privacy Policy describes how we collect, use, and protect your information when you use Talivo.

1. Data We Collect

  • Account data: email, username, and optional profile fields (name, image).
  • Authentication data: sign-in provider data needed for account login/linking.
  • Learning content: cards, media, text, topics/decks, and progress data.
  • Settings data: language, goals, preferences, and app configuration.
  • Device/session data: auth tokens and local state required to run the app.

2. How We Use Data

We use data to:

  • operate accounts and sign-in;
  • provide learning features and synchronization;
  • support sharing, moderation, abuse handling, and safety workflows;
  • maintain security and prevent fraud;
  • improve service quality and reliability.

We do not sell personal data.

3. Sharing and Visibility

  • UGC is private by default.
  • UGC is shared with other users only through accepted friend relationships and accepted topic-deck sharing.
  • If you choose to publish a community deck, that deck is intentionally public by design.
  • Talivo moderators/admin may access relevant content only for safety, abuse, legal, and support purposes on a need-to-know basis.

4. Retention

We retain account and service data while your account is active, and for limited periods afterward as required by law, security, abuse prevention, backup, and legitimate operational purposes.

5. Your Rights

Depending on your location, you may have rights to access, correct, delete, export, or restrict certain processing of your data. Contact info@learnfromdata.ai for requests.

6. Security

We use reasonable technical and organizational safeguards (for example, encrypted transport, access controls, and role-limited admin access). No system is perfectly secure.

7. Children

Talivo is not intended for children below the minimum age set in our Terms. If you believe a child has provided data unlawfully, contact us so we can investigate and take appropriate action.

8. Changes

We may update this Privacy Policy to reflect legal, product, or operational changes. The "Last updated" date will be revised accordingly.

These Terms and Conditions ("Terms") form a legally binding agreement between you and learnfromdata.ai ("Talivo", "we", "us", or "our") for access to and use of the Talivo mobile app, web app, APIs, and related services (collectively, the "Service").

By installing, accessing, or using the Service, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, do not install or use the Service.

1. Eligibility and Accounts

1.1 You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with permission and supervision from your parent or legal guardian where required by applicable law.

1.2 You must provide accurate account information and keep it updated.

1.3 You are responsible for safeguarding your account credentials and for all activity under your account.

1.4 You may not transfer your account without our prior written consent.

1.5 You may not create accounts by automated means, use another person's credentials, or impersonate another individual or entity.

1.6 We may require identity, ownership, or account-security verification steps when investigating fraud, abuse, legal complaints, or account compromise.

2. Service Description

2.1 Talivo provides language-learning features, including user-generated cards, decks/topics, sharing with friends, and collaborative interactions.

2.2 The Service may change over time. We may add, modify, pause, or remove features without prior notice where legally permitted.

2.3 Availability may vary by region, device, operating system, and app store policies.

3. User-Generated Content (UGC)

3.1 "UGC" means any content you upload, create, submit, display, or otherwise make available through the Service, including text, images, names, profile media, cards, topic decks, and reports.

3.2 You retain ownership of your UGC. You grant Talivo a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, cache, reproduce, adapt, process, format, transmit, display, and distribute UGC solely to operate, secure, moderate, maintain, improve, and provide the Service.

3.3 You represent and warrant that:

  • you have all rights needed to submit your UGC;
  • your UGC does not infringe or violate rights of others;
  • your UGC complies with these Terms and applicable laws.

3.4 UGC is private by default. No other user can access your UGC unless:

  • you and the other user are accepted friends; and
  • you explicitly share content through Talivo's topic-deck sharing flow; and
  • the receiving user accepts the sharing request.

3.4.a Community decks are a deliberate public-sharing mode. If you choose to publish content as a community deck, you explicitly authorize broader visibility to users beyond your accepted friends, as defined by product functionality at that time.

3.5 Outside those accepted friend-and-share flows, UGC is not made visible to other users. Talivo personnel and authorized processors may access UGC only on a strict need-to-know basis for operations, security, fraud prevention, abuse handling, legal compliance, and support.

3.6 We do not make your UGC publicly searchable by default.

3.7 You remain solely responsible for your UGC and for consequences of sharing decisions made through available privacy and sharing controls.

4. Prohibited Content and Conduct

You may not use the Service to create, upload, share, request, distribute, or promote content or behavior that includes:

  • Illegal activity or instructions for illegal activity.
  • Child sexual abuse material, child exploitation, or grooming behavior.
  • Sexual violence, non-consensual intimate imagery, or exploitation.
  • Terrorist content, violent extremism, or credible threats of violence.
  • Harassment, hate speech, bullying, stalking, or targeted abuse.
  • Doxxing, privacy invasion, or unauthorized disclosure of personal data.
  • Impersonation, identity fraud, phishing, scams, or deceptive practices.
  • Malicious software, harmful code, or attempts to disrupt systems.
  • Copyright, trademark, or other intellectual property infringement.
  • Spam, coordinated inauthentic behavior, or artificial amplification.
  • Content designed to exploit, endanger, or harm minors.

You may not:

  • evade enforcement, safety restrictions, or account actions;
  • create replacement accounts to bypass suspensions or blocks;
  • abuse reporting systems with malicious or knowingly false reports;
  • attempt to access or disclose content that is not authorized for you.

5. Moderation, Enforcement, and Appeals

5.1 We may use automated and human review to detect and act on violations.

5.2 Where lawful, we may warn, remove content, limit visibility, restrict features, freeze sharing, suspend accounts, or terminate access for policy, safety, or legal violations.

5.3 We may preserve and disclose relevant information where required by law, valid legal process, or to protect rights, safety, and platform integrity.

5.4 Users can report content/accounts through in-app reporting tools. We may prioritize severe safety and legal risks.

5.5 If your content or account is actioned, we may provide notice, reason codes, and an appeal path where required by law and safety constraints.

5.6 We may maintain moderation records, evidence snapshots, and audit logs for safety, legal, and quality-control purposes, subject to applicable retention requirements.

6. Friend Requests, Sharing, and Social Features

6.1 You are responsible for deciding who can interact with your content and account.

6.2 Sharing features are provided "as-is" and are limited by product controls, including friend status and explicit share acceptance.

6.3 You may not use social features to evade blocks, re-contact users who revoked access, or conduct harassment/spam.

6.4 Access rights to shared decks can be revoked by platform action or feature changes where necessary for safety, security, legal compliance, or product integrity.

7. Reporting Abuse

7.1 You can report users or content via in-app tools.

7.2 Abuse of reporting systems (false, malicious, or mass reports) may result in restrictions.

7.3 We do not guarantee any specific outcome for each report, but we review reports according to internal severity and queueing criteria.

8. Intellectual Property and Copyright Complaints

8.1 The Service, excluding user-owned UGC, is owned by learnfromdata.ai or its licensors and protected by applicable laws.

8.2 If you believe content infringes your copyright or other IP rights, contact us at info@learnfromdata.ai with:

  • identification of the work claimed infringed;
  • identification of allegedly infringing material;
  • your contact details;
  • a good-faith statement and authority statement.

8.3 We may remove allegedly infringing content and may terminate repeat infringers where appropriate.

8.4 We may request additional details to validate ownership, authority, and scope of the claim before taking final action.

9. Privacy and Data Handling

9.1 Our Privacy Policy explains how we collect, use, share, and retain personal data.

9.2 By using the Service, you acknowledge processing of data as described in the Privacy Policy, including moderation-related processing and retention for safety and legal compliance.

9.3 Safety- and abuse-related processing may include automated signals, account-link analysis, and investigator review where permitted by law.

10. Paid Features and Subscriptions

10.1 Some features may require payment or subscription.

10.2 Billing, renewals, cancellation, refunds, and taxes may be handled by Apple App Store, Google Play, or other providers under their terms.

10.3 We may change pricing, packages, or paid feature scope in the future where lawful and with required notice.

11. Third-Party Services

11.1 The Service may integrate third-party sign-in, hosting, payment, or other providers.

11.2 We are not responsible for third-party services, websites, or terms; your use of those services is governed by their policies.

12. Service Availability and Changes

12.1 We do not guarantee uninterrupted, secure, or error-free operation.

12.2 We may suspend access for maintenance, security, abuse prevention, legal compliance, or technical reasons.

12.3 We may deploy updates required for safety, legal, and interoperability reasons. Continued use may require installing updated versions.

13. Disclaimers

13.1 The Service is provided on an "as is" and "as available" basis to the fullest extent permitted by law.

13.2 We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are prohibited by law.

13.3 We do not endorse or guarantee the accuracy, safety, legality, or quality of UGC posted by users.

14. Limitation of Liability

14.1 To the maximum extent permitted by law, learnfromdata.ai and its affiliates, officers, employees, and agents are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, data, goodwill, or business interruption.

14.2 To the extent liability cannot be excluded, our aggregate liability for claims arising from or relating to the Service will not exceed the greater of:

  • the amount you paid to us for the Service during the 12 months before the claim; or
  • EUR 100.

14.3 Nothing in these Terms excludes or limits liability that cannot be excluded by law, including certain rights for consumers.

15. Indemnification

You agree to defend, indemnify, and hold harmless learnfromdata.ai and its affiliates, officers, employees, and agents from claims, liabilities, losses, and expenses (including reasonable legal fees) arising from your UGC, your use of the Service, or your violation of these Terms or applicable law.

16. Suspension and Termination

16.1 You may stop using the Service at any time.

16.2 We may suspend or terminate your access if you violate these Terms, create legal/safety risk, or where required by law.

16.3 Clauses that by nature should survive termination (e.g., IP, disclaimers, liability limits, indemnity, dispute terms) survive termination.

17. Governing Law and Disputes

17.1 These Terms are governed by the laws of Belgium, excluding conflict-of-laws principles.

17.2 If you are a consumer residing in the EU/EEA/UK/Switzerland, mandatory consumer protections in your country of residence remain applicable.

17.3 Courts of Brussels, Belgium have non-exclusive jurisdiction, subject to mandatory consumer forum rights.

18. Changes to These Terms

18.1 We may update these Terms to reflect legal, security, or product changes.

18.2 We will update the "Last updated" date and provide additional notice where legally required.

18.3 Continued installation, access, or use after updated Terms become effective constitutes acceptance of the updated Terms.

Community Guidelines

These Community Guidelines explain what is and is not allowed in Talivo. They apply to all user-generated content (UGC), including cards, topic/deck names, profile media, text, images, and sharing behavior.

These Guidelines complement the Terms and Conditions and Privacy Policy. Violations may lead to content removal, sharing restrictions, suspension, or account termination.

1. Core Principles

  • Safety first: do not post or share content that can harm people.
  • Respect and dignity: treat others without harassment or humiliation.
  • Privacy by default: content is not public and should stay within intended sharing boundaries.
  • Authenticity: do not impersonate others or manipulate users through fraud.
  • Lawful use: do not use Talivo for illegal activity.

2. Visibility and Sharing Model

  • UGC is private by default.
  • Another user can only access your content when:
    • friend request is mutually accepted; and
    • you explicitly share a topic deck; and
    • the share request is accepted by the recipient.
  • Exception: if you intentionally publish a community deck, that deck is public by design and may be visible beyond your friend graph.
  • No user browsing/discovery outside these accepted flows.
  • Talivo moderators/admin may access limited content only for abuse review, safety handling, legal compliance, or support.

3. What Is Allowed

Examples of acceptable use:

  • Original language-learning cards and notes.
  • Respectful educational content.
  • Personal examples that do not expose others' private data.
  • Constructive corrections and non-abusive feedback.

4. Prohibited Content and Conduct

4.1 Child Safety (Zero Tolerance)

Strictly prohibited:

  • Child sexual abuse material (CSAM).
  • Sexualized content involving minors.
  • Grooming behavior, solicitation, or exploitation of minors.

Enforcement: immediate removal and highest-severity account action, with legal escalation where required.

4.2 Violence and Dangerous Conduct

Prohibited:

  • Credible violent threats.
  • Incitement of violence or terrorism.
  • Instructions that meaningfully facilitate serious harm.

4.3 Hate, Harassment, and Abuse

Prohibited:

  • Hate speech or dehumanizing attacks based on protected characteristics.
  • Bullying, stalking, or targeted harassment.
  • Sexual harassment or repeated unwanted contact.
  • Encouraging self-harm or suicide.

4.4 Sexual Exploitation and Non-Consensual Content

Prohibited:

  • Non-consensual intimate imagery.
  • Sexual extortion, coercion, or exploitation.
  • Content that sexualizes violence or coercion.

4.5 Privacy and Personal Data Abuse

Prohibited:

  • Doxxing (posting private contact/location/identity data without permission).
  • Sharing personal data of third parties without lawful basis.
  • Attempts to access private content or accounts without authorization.

4.6 Fraud, Impersonation, and Deceptive Behavior

Prohibited:

  • Impersonating a real person, brand, or organization.
  • Phishing, scams, financial fraud, and social engineering.
  • Deceptive links or false claims intended to exploit users.

4.7 Spam and Platform Manipulation

Prohibited:

  • Mass unsolicited invites/sharing requests.
  • Repetitive low-value content intended to spam.
  • Coordinated manipulation or synthetic amplification.
  • Abuse of reporting tools with malicious false reports.

4.8 Illegal and Infringing Content

Prohibited:

  • Content that violates applicable law.
  • Copyright/trademark/IP infringement.
  • Malware, exploits, or attempts to compromise platform integrity.

5. Intellectual Property Expectations

  • Only upload content you own or are permitted to use.
  • Respect copyright, trademark, and privacy rights.
  • If your rights are infringed, report through legal contact channels with sufficient evidence.

6. Reporting and Appeals

  • Use in-app report tools for users/content.
  • Provide accurate reason and context.
  • Deliberate false reporting may itself be a violation.
  • If your content/account is actioned, Talivo may provide an appeal path where required by law and safety constraints.

7. Enforcement Framework

Talivo may apply one or more of the following actions:

  • Warning or educational notice.
  • Content removal.
  • Feature restrictions (for example, sharing limits).
  • Temporary suspension.
  • Permanent account termination.
  • Legal escalation when required.

Severity guidance

  • Critical: child exploitation, credible violent threat, severe exploitation/fraud.
    • Typical outcome: immediate removal and severe account action.
  • High: hate harassment, doxxing, major scams, repeated abusive behavior.
    • Typical outcome: removal plus strong account restrictions.
  • Medium: spam, abusive contact, repeated low-severity violations.
    • Typical outcome: removal and progressive restrictions.
  • Low: first-time borderline non-malicious violations.
    • Typical outcome: warning and corrective guidance.

Repeat violations increase enforcement severity.

8. Repeat-Offender Policy

Talivo may escalate actions for repeated or evasive violations, including:

  • longer suspensions;
  • share/friend feature lockouts;
  • permanent account removal;
  • ban evasion detection and linked-account actions where lawful.

9. Moderator Access and Evidence Handling

  • Moderator/admin access is limited to legitimate operational purposes.
  • We may preserve evidence snapshots and action logs for safety, legal, and quality review.
  • We do not expose moderation evidence to unrelated users.

10. Changes to Guidelines

We may update these Guidelines to reflect product changes, legal requirements, or safety learnings. Continued use of Talivo after updates means you accept the updated Guidelines.

Data and Account Deletion

This page explains how to delete your account or delete your content while keeping your account.

1. Delete Your Account

In the app:

  1. Go to Profile.
  2. Open Settings.
  3. Choose "Delete account".
  4. Tap "Delete my account".
  5. Type DELETE and confirm.

Result:

  • Your account is permanently deleted.
  • Associated personal content is removed according to system constraints and legal obligations.
  • Shared resources relied on by other users may be retained where technically necessary or legally required.

2. Delete Your Data (Keep Account)

In the app:

  1. Go to Profile.
  2. Open Settings.
  3. Choose "Delete all data".
  4. Tap "Delete all my data (keep account)".
  5. Type DELETE DATA and confirm.

Result:

  • Your created learning content and profile content are removed.
  • Your sign-in/account identity remains so you can continue using Talivo.

3. Safety, Legal, and Operational Exceptions

In limited cases, certain records may be retained for legal compliance, fraud prevention, abuse handling, dispute resolution, and backup recovery windows.

How to request account deletion

In the Talivo app:

  1. Open Profile.
  2. Open Settings.
  3. Go to the Delete account section.
  4. Tap Delete my account.
  5. Type DELETE and confirm.

After confirmation, deletion starts immediately and cannot be undone.

What we delete

When deleting your account, Talivo removes:

  • Your account identity (email, username, profile fields, linked sign-in methods).
  • Your personal learning data (cards, progress, exercises, settings tied to your account).
  • Your personal profile media and account-linked notifications.

What may remain

In limited cases, some shared or system-level records may be retained when required for:

  • legal compliance;
  • abuse prevention and platform safety;
  • short-lived backup recovery windows;
  • integrity of shared resources that other users still rely on.

Need to keep your account?

If you want to remove your content but continue using Talivo, use Delete all my data (keep account) in the same settings area.

How to request data deletion

In the Talivo app:

What we delete

When deleting data but keeping your account, Talivo removes:

  • your cards, progress, exercises, and created learning content;
  • your profile media and display metadata tied to deleted content;
  • your owned-only topics and account-linked content state where applicable.

What we keep

To let you sign in again, Talivo keeps your account identity:

  • email and username;
  • authentication method (password/Google/Apple links);
  • minimum account metadata needed for access and security.

If you want complete removal of both account and data, use Delete my account instead.
